1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between KuchenGerat and its customers.
1.2 Deviating terms and conditions of the customer shall not apply, unless expressly agreed upon in writing.
2. Contract Conclusion
2.1 The presentation of goods in the online shop constitutes a non-binding invitation to submit an offer.
2.2 The customer submits a binding offer by placing an order.
2.3 The Seller confirms the order by sending an order confirmation or by delivering the goods.
3. Prices and Payment
3.1 The prices indicated in the online shop are inclusive of the applicable statutory VAT.
3.2 Payment can be made by major credit cards and paypal.
3.3 In case of default in payment, the Seller is entitled to charge interest on arrears.
4. Delivery and Transfer of Risk
4.1 Delivery takes place to the delivery address specified by the customer.
4.2 The risk of accidental loss or damage to the goods passes to the customer upon transfer of the goods to the carrier.
4.3 If the delivery is delayed due to circumstances beyond the Seller’s control, the delivery deadline is extended accordingly.
5. Retention of Title
5.1 The Seller retains title to the goods until full payment of the purchase price.
6. Right of Withdrawal
6.1 Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
6.2 The withdrawal period is fourteen days from the day on which the consumer or a third party named by them who is not the carrier has or has taken possession of the last goods.
6.3 To exercise the right of withdrawal, the consumer must inform the Seller of their decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or email).
6.4 If the consumer exercises the right of withdrawal, they shall bear the direct cost of returning the goods.
7. Warranty
7.1 The Seller is liable for defects in accordance with the statutory provisions.
7.2 The warranty period is 2 years.
8. Liability
8.1 The Seller is liable for damages caused intentionally or by gross negligence.
8.2 Liability for slight negligence is limited to foreseeable damages and typical contractually assumed risks.
8.3 Liability for damages resulting from the loss of data is excluded, unless caused intentionally or by gross negligence.

9. Dispute Resolution

9.2 We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
10. Final Provisions
10.1 The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on the International Sale of Goods.
10.2 If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
